1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Buyer," "Customer," "You") and Mini Teacup Puppies ("We," "Us," "Our"). By accessing our website, submitting an inquiry, reserving a puppy, or completing a purchase, you agree to be bound by these Terms.

We reserve the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting. Your continued use of our website or services constitutes acceptance of the updated Terms.

2. Puppy Information and Representation

We strive to provide accurate and up-to-date information about our available puppies, including breed, age, color, size, health status, and temperament.

• Accuracy of Listings: While we make every effort to ensure accuracy, we do not guarantee that all information is error-free. Slight variations in color, size, and temperament may occur.
• Health Status: All puppies receive a veterinary health check, age-appropriate vaccinations, and deworming before being listed. Health records are provided upon purchase.
• Breed Representation: We represent puppies to the best of our ability based on available information. However, we cannot guarantee breed purity for mixed breeds.
• Photography: Photos on our website are of the actual puppy whenever possible. Colors may vary slightly due to lighting and monitor settings.

3. Reservation and Purchase Process

The process for reserving and purchasing a puppy is governed by our Reservation Policy, Refund Policy, and Payment Policy, which are incorporated by reference into these Terms.

• Reservation: A puppy is reserved upon receipt of the $400 deposit and signing of the reservation agreement. Reservations are on a first-come, first-served basis.
• Purchase Completion: The purchase is complete when the full balance is paid, the purchase agreement is signed, and the puppy is delivered or picked up.
• Age Requirements: Puppies are typically released to new homes at 8–10 weeks of age, depending on the breed and individual development.

4. Health Guarantee

Every puppy comes with a one-year health guarantee covering qualifying congenital and hereditary conditions. Full details are provided in our Health Guarantee document, which is incorporated by reference into these Terms.

Key conditions of the health guarantee include:

• 72-Hour Examination: You must have the puppy examined by a licensed veterinarian within 72 hours of receiving them.
• Coverage Period: The guarantee is valid for one year from the date of purchase.
• Covered Conditions: The guarantee covers qualifying congenital and hereditary conditions as defined in the health guarantee agreement.
• Notification: You must notify us in writing of any health issues within the guarantee period and provide supporting veterinary documentation.

5. Buyer Responsibilities

As a responsible pet owner, you agree to:

• Proper Care: Provide your puppy with proper nutrition, veterinary care, exercise, grooming, and a safe living environment.
• Veterinary Care: Have your puppy examined by a licensed veterinarian within 72 hours of receipt and regularly thereafter.
• Vaccinations: Keep your puppy up to date on all recommended vaccinations and preventive care.
• Socialization: Provide proper socialization and training to ensure your puppy develops into a well-adjusted adult dog.
• Compliance: Comply with all applicable local, state, and federal laws regarding pet ownership, licensing, and animal welfare.

6. Delivery and Shipping

Delivery and shipping terms are governed by our Shipping & Delivery policy, which is incorporated by reference into these Terms.

• Risk of Loss: The risk of loss and title to the puppy passes to you upon delivery or pickup.
• Shipping Costs: Delivery costs are the responsibility of the buyer and are quoted based on location and preferred method.
• Travel Crate: You are responsible for providing an approved travel crate or carrier for your puppy.

7. Limitation of Liability

To the fullest extent permitted by law, Mini Teacup Puppies shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Any loss of use, data, business, or profits.
• Any damages arising from the use or inability to use our website or services.
• Any damages arising from the health or behavior of the puppy after delivery.

Our total liability to you for any claim arising out of or relating to these Terms or your purchase shall not exceed the total amount paid by you for the puppy.

8. Indemnification

You agree to indemnify, defend, and hold harmless Mini Teacup Puppies, its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

• Your use of our website or services.
• Your breach of these Terms.
• Your violation of any law or the rights of any third party.
• Your ownership or care of the puppy after purchase.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms, your purchase, or your relationship with Mini Teacup Puppies shall be resolved as follows:

• Negotiation: The parties shall attempt to resolve any dispute through good-faith negotiations.
• Mediation: If negotiations fail, the parties shall attempt to resolve the dispute through mediation with a mutually agreed-upon mediator.
• Arbitration: If mediation fails, the dispute shall be resolved through binding arbitration in San Diego County, California, in accordance with the rules of the American Arbitration Association.

10. Entire Agreement

These Terms, together with our Reservation Policy, Refund Policy, Payment Policy, Privacy Policy, and Health Guarantee, constitute the entire agreement between you and Mini Teacup Puppies and supersede all prior or contemporaneous communications and proposals, whether oral or written.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be replaced with a valid provision that most closely reflects the original intent.

12. Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Mini Teacup Puppies.
